Cops: Unconscious teen raped by 2 men in Gwinnett

Two men raped a 16-year-old girl in a car while she was passed out drunk, Gwinnett County police said.

Arni Jared Andrade Chavez, 20, of Lawrenceville, has been charged with rape and aggravated sodomy. Josue Rodriguez, 18, has been charged with rape and contributing to the delinquency of a minor.

On April 18, the victim sneaked out of her Lawrenceville home to meet up with Chavez and the co-defendant. She had planned to go to a construction site in Duluth and drink with the two men, Detective J.D. VonBehren said at a June 21 hearing. Chavez picked her up alone and tried to initiate sex, but she refused, VonBehren said. The girl had been dating Chavez for a month or two, but she had previously refused his advances when he tried to have sex with her, according to VonBehren.

The pair met up with Rodriguez at the construction site, and the co-defendant provided the victim with a 12-oz. water bottle filled with vodka. The victim drank all of the vodka and later passed out in the car.

While the victim was passed out, Chavez had oral and vaginal sex with her, VonBehren said. Rodriguez then also had vaginal sex with the victim, according to VonBehren. The victim was unconscious the entire time and was unable to consent, he said.

After, they drove her back to her home. They tried to carry her unconscious body to her bedroom window, but she urinated on them, causing them to drop her, VonBehren said. One of the men managed to get into the house; they returned the victim to her bed and left.

The next day at 6 a.m., the victim’s mother found her still unconscious, with leaves in  her hair and urine on her clothes, VonBehren said. When the victim would not wake up, her mother called 911 and the girl was transported to a hospital. Her blood alcohol content was 0.34, more than four times the legal level of intoxication, and she had injuries to her vagina and anus. Hospital staff determined that a sexual assault had taken place and called police.

The victim told police she had gone to the construction site with Chavez and the co-defendant, which police corroborated with geotagged photos on the victim’s phone and other cell phone records, VonBehren said. Both Chavez and the co-defendant admitted to having sex with the victim, according to VonBehren.

Chavez was arrested on June 1 and Rodriguez was arrested on May 21, jail records show. Chavez and Rodriguez are being held at the Gwinnett County Detention Center without bond. The issue of bond will be addressed by Gwinnett County Superior Court at a later date.
