Investigators worked to determine Wednesday which vehicle struck a kindergarten student within his DeKalb County apartment complex.

Robert Love, 5, died Tuesday afternoon after being struck by a vehicle. But investigators said witness accounts differed on who was responsible.

Robert was walking with an 8-year-old boy when the younger child was hit at the Kensington Station apartments, according to Mekka Parish, spokeswoman for DeKalb County police. The victim was transported to the hospital, where he died.

Witnesses gave conflicting accounts of which vehicle was involved, Parish said.

The driver of a FedEx truck stopped, was questioned and released, according to police. It was not known if the truck or another vehicle struck the boy, Parish said.

The other boy was not injured.

Robert, who attended Midway Elementary School, lived in the complex with his mother and older brother, a relative told Channel 2 Action News.

“It’s a tragedy what happened to him cause he was just coming home from school, you now, doing the right thing,” the boy’s uncle, E. Harris, said. “We just hurt a lot, for him to be taken so young.”

The investigation into the child’s death continues. It was not known if any criminal charges will be filed.
