DeKalb County Sheriff Jeff Mann is back at work, more than two months after police said he exposed himself at a public park and ran away from an officer.

Gov. Nathan Deal suspended Mann last month for 40 days after he was charged with indecency and obstruction. Deal made the decision based on the recommendation of an investigatory committee made up of two sheriffs and Attorney General Chris Carr.

Mann was arrested at Piedmont Park on May 6, according to a police report.

Mann asked a judge to acquit him because Deal was already punishing him with the suspension. Mann’s attorney, Noah Pines, wrote in a court filing that Mann can’t be prosecuted twice for the same offense.

He has pleaded not guilty. His trial is scheduled for Thursday in Atlanta Municipal Court.
